By the Order of 26 February 2016, a new fee schedule was established setting the regulated fees for notaries pursuant to law n° 2015-990 of 6 August 2015 on growth, economic activity, and equal economic opportunities, and Decree n° 2016-230 of 26 February 2016 concerning the fees of certain legal professionals and the interprofessional fund for access to law and justice.

This fee schedule applies to the main services provided by notaries (real estate sales, mortgages, gifts, prenuptial agreements, property division, heir identification affidavits, inheritance tax declarations, etc.).

Fees agreed upon by mutual agreement for certain services

Certain services provided by the notary are not included in the list of fee-based services (such as commercial leases, corporate documents, documents related to business assets or legal consultations). The fees for these services are determined by mutual agreement between the notary and the client.

The same applies to client consultations regarding services that are separate from the preparation, drafting or execution of the agreement.

These costs are referred to as “agreed fees” (honoraires).

Article L444-1 of the French Commercial Code provides that the determination of these fees must be set forth in an agreement signed by the notary and the client.
